These Terms and Conditions (“Terms”) form a legally binding agreement between WORLD STORE LIMITED, a company incorporated in England and Wales under company number 13767315, with its registered office at 35 Firs Avenue, London, N11 3NE, operating under the trade name AtlasSIM (“AtlasSIM,” “we,” “us,” or “our”), and you, the individual or entity (“you,” “User,” or “Customer”) accessing or utilizing our website at https://atlassim.org, mobile applications, or any related services (collectively referred to as the “Platform”).
The Platform is designed to provide electronic SIM cards (“eSIMs”) and associated mobile connectivity services (collectively, the “Services”). By accessing our Platform, creating an account, or purchasing any Services, you agree to be bound by these Terms in their entirety. If you find any part of these Terms unacceptable, you must refrain from using the Platform or any associated Services.
1. Definitions
To ensure clarity, the following terms used throughout this document have specific meanings:
eSIM: An embedded Subscriber Identity Module that allows you to activate, store, and manage mobile network plans digitally, eliminating the need for a physical SIM card.
User/You/Customer: Any individual or legal entity who accesses the Platform, registers an account, purchases an eSIM, or uses our Services.
Platform: Encompasses the website at https://atlassim.org, our mobile applications, and other digital interfaces we operate to facilitate the sale and management of eSIMs.
Services: Include the provision of eSIMs, mobile data plans, activation support, customer service, account management tools, and other connectivity-related offerings available through the Platform.
Account: A personalized profile you create on the Platform to access and manage our Services.
Plan: A specific mobile data package tied to an eSIM, outlining details such as data allowance, validity period, and geographic coverage.
Network Operator/Carrier: Third-party telecommunications providers that deliver the connectivity services associated with our eSIMs.
Order: A confirmed purchase of one or more Services made through the Platform.
Personal Data: Any information about an identifiable individual that we collect and process, as outlined in our Privacy Policy.
Business Day: Any day excluding weekends (Saturday and Sunday) and official public holidays in England and Wales.
2. Eligibility and Account Requirements
To use our Services, you must meet and maintain compliance with the following criteria:
Age and Legal Capacity: You must be at least 18 years of age or possess the legal authority to enter into binding contracts under the laws applicable in your jurisdiction.
Accurate Information: You agree to provide truthful, up-to-date, and complete information when registering, making purchases, or interacting with the Platform, and to promptly update this information to ensure its accuracy.
Legal Compliance: Your use of the Services must comply with all relevant local, national, and international laws, as well as telecommunications regulations.
Account Security: You are responsible for safeguarding your account credentials, including usernames, passwords, and authentication codes. You must restrict unauthorized access to your account and immediately notify AtlasSIM of any security breaches or misuse.
Prohibited Access: You may not use the Services in jurisdictions where they are restricted, prohibited, or would violate applicable laws. AtlasSIM reserves the right to deny or restrict access to the Platform or Services in such cases.
3. Description of Services
AtlasSIM offers electronic SIM cards (eSIMs) that enable you to access mobile data and connectivity through our trusted partner mobile network operators worldwide. The following terms govern the use of these Services:
eSIM Activation: After purchasing an eSIM, you will receive a QR code, activation code, or detailed instructions to install and activate the eSIM on a compatible device.
Coverage and Performance: The availability, quality, and speed of connectivity depend on third-party network operators, your location, and network conditions. AtlasSIM cannot guarantee uninterrupted or flawless connectivity due to these external factors.
Plan Details: Each eSIM plan specifies its data allowance, validity period, pricing, and supported regions, all of which are clearly outlined at the time of purchase.
Device Compatibility: It is your responsibility to confirm that your device supports eSIM technology, is unlocked from carrier restrictions, and is compatible with the selected plan. AtlasSIM is not liable for issues arising from device incompatibility.
Third-Party Limitations: AtlasSIM is not responsible for disruptions, restrictions, or inconsistencies caused by third-party network operators, such as roaming limitations or service outages.
Customer Support: We provide comprehensive support, including activation guidance, troubleshooting, and assistance with managing your Services.
4. Purchase and Payment Terms
4.1 Order Placement
All orders placed through the Platform are subject to our acceptance and confirmation. We reserve the right to refuse, cancel, or limit any order at our discretion, particularly in cases of suspected fraud, misuse, or violation of these Terms.
4.2 Pricing
Prices for our Services are displayed on the Platform, typically in Euros (EUR). Prices include applicable taxes unless otherwise stated. We may adjust pricing at any time, but confirmed orders will not be affected by subsequent changes.
4.3 Payment
Payments must be made using approved methods, such as credit/debit cards, digital wallets, or other electronic payment systems offered on the Platform. By providing payment details, you confirm your authorization to use the selected payment method and permit AtlasSIM (or our third-party payment processors) to charge the full order amount.
4.4 Refund and Cancellation Policy
All sales are final, and refunds or cancellations are only permitted under specific conditions:
The eSIM is defective or cannot be activated due to an error directly caused by AtlasSIM.
A refund is mandated by applicable consumer protection laws.
To request a refund, contact our customer support team in writing within a reasonable timeframe from the purchase date, providing any required documentation. Approved refunds will be processed using the original payment method unless otherwise agreed.
5. User Responsibilities and Obligations
5.1 Compliance
You agree to use the Services in full compliance with these Terms, all applicable laws, and the policies of third-party network operators providing connectivity.
5.2 Prohibited Use
You must not engage in activities that are illegal, fraudulent, abusive, or otherwise prohibited, including unauthorized resale of Services, attempts to manipulate network access, or actions that could harm the Platform or third-party networks.
5.3 Device Compatibility
You are responsible for verifying that your device is eSIM-compatible, unlocked, and suitable for the chosen plan before making a purchase. AtlasSIM is not liable for issues stemming from incompatible or locked devices.
5.4 Account Security
You must protect the confidentiality of your account credentials and promptly report any unauthorized access or security breaches to AtlasSIM.
5.5 Responsibility for Use
You accept full responsibility for all activities conducted through your account and agree to bear any resulting charges or damages from misuse of the Services.
6. Intellectual Property Rights
6.1 Ownership
All content and materials on the Platform, including text, graphics, logos, icons, images, software, and digital downloads, are the exclusive property of AtlasSIM or our licensors, protected by copyright, trademark, and other intellectual property laws.
6.2 Limited License
By complying with these Terms, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform and Services for personal or business purposes.
6.3 Restrictions
You may not reproduce, distribute, modify, publicly display, or otherwise exploit any Platform content without our prior written consent, except as permitted by law.
6.4 Trademarks
The AtlasSIM name, logo, and related marks are our trademarks or service marks. Unauthorized use of these marks is strictly prohibited.
7. Limitation of Liability
7.1 Exclusion of Certain Damages
To the extent permitted by law, AtlasSIM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, such as loss of profits, revenue, or data, arising from your use or inability to use the Services.
7.2 Limitation of Aggregate Liability
Our total liability, whether in contract, tort, or otherwise, will not exceed the amount you paid for the specific Service giving rise to the claim.
7.3 No Guarantee of Network Performance
We do not guarantee the availability, quality, or speed of third-party mobile networks and are not responsible for disruptions or failures caused by such networks.
7.4 Mandatory Consumer Rights
These Terms do not limit or exclude liability that cannot be restricted under applicable consumer protection laws.
8. Third-Party Services
8.1 Network Operators
Our Services depend on third-party mobile network operators for connectivity. We do not own or control these networks and are not liable for interruptions, coverage issues, or performance problems caused by them.
8.2 Device Compatibility
You are responsible for ensuring your device is eSIM-compatible and unlocked. AtlasSIM is not liable for issues due to device limitations or restrictions.
8.3 External Factors
We are not responsible for failures or delays caused by factors beyond our control, such as third-party software, hardware, or regulatory requirements.
8.4 Third-Party Terms
Your use of the Services may be subject to the terms and policies of third-party providers, such as network operators or payment processors, which you agree to follow.
9. Privacy and Data Protection
Our collection, use, and protection of your personal information are governed by our Privacy Policy, which forms an integral part of these Terms.
10. Termination of Access
10.1 Right to Suspend or Terminate
We reserve the right to suspend, restrict, or terminate your access to the Platform or Services if you violate these Terms, engage in fraudulent or unlawful activities, or misuse the Services.
10.2 Immediate Termination
Termination may occur without notice if your actions pose a risk to AtlasSIM, our partners, or other users, or if required by law.
10.3 Effect of Termination
Upon termination, your access to the Services will cease immediately, and we will not be liable for any resulting losses.
10.4 Survival of Provisions
Provisions such as payment obligations, intellectual property rights, and liability limitations will survive termination.
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms and any related disputes are governed by the laws of England and Wales, excluding conflict of law principles.
11.2 Jurisdiction
The courts of England and Wales have exclusive jurisdiction over any disputes arising from these Terms or the Services.
11.3 Alternative Dispute Resolution
Before pursuing legal action, both parties agree to attempt resolution through good-faith negotiation or, if mutually agreed, mediation.

13. Force Majeure
13.1 Definition
AtlasSIM is not liable for delays or failures in performing our obligations due to events beyond our reasonable control (“Force Majeure Events”).
13.2 Examples of Force Majeure Events
These include natural disasters, fires, floods, wars, terrorism, strikes, pandemics, government actions, or telecommunications failures.
13.3 Suspension of Obligations
During a Force Majeure Event, our obligations are suspended to the extent they are impacted.
13.4 Notification
We will make reasonable efforts to notify you of such events and resume performance as soon as possible.

15. Entire Agreement

This agreement replaces all prior understandings or agreements, whether written or oral, related to the Services.
15.3 No Other Representations
No statements or promises made by AtlasSIM or its representatives are binding unless explicitly included in these Terms.
16. Severability
16.1 Partial Invalidity
If any provision of these Terms is deemed invalid or unenforceable, it will be enforced to the fullest extent permitted by law.
16.2 Continuation of Terms
The invalidity of one provision does not affect the enforceability of the remaining Terms.
16.3 Replacement Provision
If a provision is invalid, a substitute provision reflecting the original intent will be applied.
